Book Description: With a Foreword by Lars Vinx, this book is the first complete English translation of the Italian jurist, Emilio Betti’s classic work Die Hermeneutik als allgemeine Methodik der Geisteswissenschaften, originally published in 1962. Betti’s hermeneutical theory is presented here as a ‘general methodology of the sciences of the spirit’, such as to allow the achievement of objectivity, however relative it might be. Its central focus is the tension between an object, to be considered in its autonomy, and the subjectivity of the interpreter, who can understand the object only by means of his or her own categories, historical-cultural conditions, and interests. Set against the work of Bultmann and Gadamer, Betti is concerned to limit the arbitrariness of subjectivity without diminishing the place of interpretation. Detailing the principles that govern, and therefore, guide any interpretation, Betti traces how interpretation in art and in literature, as well as in the fields of science, jurisprudence, sociology, and economy, can be said to be objective, albeit only ever in a relative sense. This summa of Betti’s key contribution to hermeneutic theory will be of interest across a range of disciplines, including legal and literary theory, philosophy, as well as the history and sociology of law.

Hermeneutics is concerned with the character of understanding, especially as it is related to interpreting linguistic texts. Palmer principally treats the conception of hermeneutics enunciated by Heidegger and developed into a “philosophical hermeneutics” by Hans-Georg Gadamer. He provides a brief overview of the field of hermeneutics by surveying some half-dozen alternate definitions of the term and by examining in detail the contributions of Friedrich Schleiermacher and Wilhelm Dilthey. In the “Manifesto” which concludes the book, Palmer suggests the potential significance of hermeneutics for literary interpretation. When the context of interpretation is pressed to its limits, hermeneutics becomes the philosophical analysis of what is involved in every act of understanding. The concept of evidence is expected to fulfill a number of distinct roles in science and philosophy, but also in legal theory and law, some of which are complementary, while others are conflicting. In their profession, lawyers have to deal with evidence and proof. Yet the legal concept of evidence is constantly changing, and the debate concerning the distinction between a legal concept of evidence, the ordinary concept of evidence and the concept of evidence in science is far from being settled. What is more, the problem of evidence is central to both epistemology and the philosophy of science, and by extension to our academic thinking on law. In short, legal theorists’ interest in evidence may include such diverse objects as a bloody knife, sensory data, linguistic entities or psychologically recognized beliefs. The book surveys selected theoretical roles that the concept of evidence plays and explores their relations and interconnections. The content is divided into three parts, investigating: (1) evidence in epistemology and the philosophy of science, which focuses on evidence methodologies and the problem of proof in legal scholarship; (2) evidence in legal theory and legal philosophy, where particular attention is paid to the interplay between evidence, legal reasoning and the binding force of such reasoning; and (3) evidence in law, where theoretical problems pertaining to witnesses, expert opinions, explanations of the accused, statistical evidence and neuroscientific evidence are examined.
